Binding Financial Agreements

Sometimes the best time to agree about money is while you're getting along.

A Binding Financial Agreement, sometimes called a BFA or "prenup", can document how certain financial matters will be dealt with if a relationship ends.

They can also be used in other circumstances, including after separation.

BFAs can be relevant when

  • You're entering a new relationship with existing assets.

  • You have children from an earlier relationship.

  • One person owns a business.

  • There's a significant difference in assets or income.

  • You want greater financial certainty.

  • You've separated and want to document a financial settlement using a BFA rather than Consent Orders.

Why BFAs need proper legal advice

Binding Financial Agreements have strict legal requirements. Each party needs their own independent legal advice.

We'll discuss whether a BFA is appropriate for your circumstances, advise you about the proposed agreement and guide you through the process.

What it costs

The cost of a Binding Financial Agreement will depend on your individual circumstances, the complexity of your financial arrangements and the work required. We’ll provide you with a clear fee estimate before we get started.

If we prepare your BFA
As a general guide, most BFAs we prepare are approximately $5,000–$10,000 inc GST. This is an indicative range only and the final cost may be higher or lower depending on your matter.

If the other party has prepared the BFA
If you’ve received a BFA prepared by the other party’s lawyer, we can review it and provide the independent legal advice required before you sign. We’ll confirm the cost after reviewing the agreement.
